After this, Vanitha went on to file a habeas corpus petition in Madras high court alleging that her son Vijay Sri Hari, was being illegally detained by Akash. Akash produced the boy before the court on December 14, and denied Vanitha’s allegation that he had abducted the boy on December 3 and detained him. He told that due to estranged relationship and family quarrels between Vanitha and her parents, Vanitha voluntarily surrendered the custody of the son to him(Akash) on November 7 last, as per the Child’s wish.
The boy had narrated that he was unable to live with his mother due to “ill treatment” and “cruelty” meted out to him by Anand Rajan.((whom Vanitha married after divorcing Akash)
Later on December 25, the Madras high court ruled in favour of Vanitha and ordered Akash to hand over their son Vijay Sri Hari to Vanitha within two weeks of time. However Akash refused to hand over their son to Vanitha, citing that the second marriage of Vanitha with Anand Rajan had virtually disqualified her from having any preferential right over the custody of the son.
On December 29, Vanitha learnt that Vijayakumar is flying back to Chennai from Hyderabad along with her son Srihari. She rushed to the airport along with Anandarajan to take Srihari with her as per the court order. True to this info, Vijayakumar and Vijay Sri Hari walked through the lounge when Vanitha spotted them and immediately rushed to take her son into her custody. But Vijayakumar refused to part with his grandson and held on to him tightly.
Vanitha was adament to take Srihari along with her and tried to pull the boy. The boy refused to go with Vanitha saying “I don’t want to come with you”. Vanitha replied “It doesn’t matter”, and forcibly thrown her arms around the boy’s neck and hold it tightly. Visitors and travelers at the domestic terminal in Chennai airport were shocked to see Vijayakumar and Vanitha indulging in an open fight in the public.
